Fair Market Value (FMV) Analysis
To assess whether incentive payments calculated as part of a Commercial Gainsharing Program would result in payments to physicians not in excess of FMV, each hospital should review the expected activities to be required of physicians and assess whether or not the compensation expected to be paid to those physicians would be consistent with FMV for the services expected to be provided by the participating physicians. This analysis is performed by an independent consultant.
